Congress shall make no lawIn regards to those Rights listed in The First Amendment they left it open to the States. The States (and local governments, for that matter) could still pass a law banning the burning (or sale of) books. Or the building of a church or mosque anywhere. Not that such laws would be a good idea.
But the First Amendment is specifically about States Rights versus Federal overreach. Nothing more or less until the overreach of Federal courts made it so.
