Bryan Jamsheed Tayefe Brutally Beats Jewish Man Because He Won't Remove Yarmulke - UPDATED

Two men have been arrested and charged in what Boulder police said was a bias-motivated assault against a Jewish man at a bar on the Pearl Street Mall last month. 
According to police a 22-year-old man said he was at the Sundown Saloon, 1136 Pearl St., at 12:30 a.m. Dec. 19 when three males approached him and told him to remove his yarmulke, a skullcap traditionally worn by Jewish men.
The man refused to remove the yarmulke, stating that he was Jewish. 
One of the three men then struck the victim in the side of his head with a glass, shattering the glass and knocking the victim down. A second man then kicked the victim after he fell down. The victim was taken to a local hospital with a laceration to his head that required 20 stitches. 
A bouncer was able to hold one suspect, Bryan Jamsheed Tayefeh, 29, until police arrived. He was initially charged with second-degree assault on Dec. 19, but has since also been charged with bias-motivated crime after the Boulder County District Attorney’s Office reviewed the case. 
A second suspect in the assault was identified as Yotam Monjack, 27. He was arrested on Jan. 8 upon returning from a trip to Costa Rica and also faces second-degree assault and bias-motivated crime. 
Both charges are felony counts.

But Scott Jurdem, at attorney for 29-year-old suspect Bryan Jamsheed Tayefeh said the bias-motivated charges are not warranted, noting that the second suspect, Yotam Monjack, 27, is a Jewish man from Israel.

"I don't believe that the allegation that this crime was bias-motivated is appropriate, and I think the evidence clearly contradicts that, starting with the fact one of the two men is an Israeli Jew with a huge Star of David on his Facebook page," Jurdem said.

Jurdem added that while his client is not Jewish, he is friends with many Jewish people — including Monjack.

"This kid is not anti-Semetic, and I would not represent him if he was," Jurdem said. "He is not Jewish, but he is very, very close with many Jewish people."

"There is no automatic disqualifier that hate crimes cannot occur between people of the same religious group or ethnic group."

Fight at Pearl Street bar

According to court records, Seth Fineman, 22, said he was with a friend at the Sundown Saloon, 1136 Pearl St., at 12:30 a.m. Dec. 19 when three men approached him and started a friendly conversation about the fact that both Fineman and his friend had been to Israel.

The three men then left, but about a minute later, two of them — later identified by police as Tayefeh and Monjack — came back and were confrontational, according to an arrest-warrant affidavit.

Fineman, who said he is Jewish, told police one of them told him to remove his yarmulke, a skullcap traditionally worn by Jewish men. The man also told Fineman his friend wanted to fight him, according to police.

Fineman told investigators he refused to remove the yarmulke and began to step away when Tayefeh hit him in the head with a pint glass, according to the affidavit. Both men then tumbled to the ground and were separated by a Sundown employee. But when he separated them, the employee pushed Fineman back down to the ground, and while he was on the ground, Monjack kicked him, according to an affidavit.

Another Sundown employee pushed Monjack out of the bar while a bouncer held Tayefeh in the bar, according to the affidavit. The employee did not recall whether Monjack threw a kick, but surveillance video showed Monjack kicking at Fineman, according to the affidavit.

Fineman was taken to a local hospital with a laceration to his head that required 20 stitches. He told police he does not remember what happened after he was hit in the head and said he did not know whether he was kicked.

When police arrived, Tayefeh told them he was standing with friends when Fineman yelled an anti-Semitic slur at him, according to the affidavit. He said words were exchanged, and that he threw a punch at Fineman, but forgot he had a glass in his hand.
